PD, chief, village receive notice of claim from Jaliek’s parents

GREENWICH, N.Y. – The Greenwich Police Department, Chief George Bell, and the village received a notice of claim Tuesday morning — a precursor to a lawsuit — after Jaliek Rainwalker’s adoptive parents Stephen Kerr and Jocelyn McDonald say police entered their home on February 7th without a search warrant.

Washington County DA Kevin Kortright said he does not want to discuss the case on camera, but he did say he does not believe the department acted unlawfully.

He made a statement saying, “I have worked with the Greenwich Police Department for many years and the officers have always acted lawfully. I have faith that the department and the chief did what they needed to do to obtain evidence without breaking the law.”

Meanwhile, Chief George Bell continues to defend the actions of his department.

He said, “I believe we handled ourselves within the color of the law that day when we entered 11 Hill Street.”

Bell said his officers did enter the home before the search warrant was issued, but they did not do anything illegal.

“There was no searching done until the search warrant was in our hands and signed by the judge.”

Bell also said Stephen and Jocelyn were home when police got there, but they were not detained by police. Their lawyer said the couple was illegally detained the day police seized the evidence from the home.

“It’s just another thing that Stephen and Jocelyn…it just shows where their intent is. It’s not about finding Jaliek. It’s about throwing up these smoke screens all around the case,” said Bell.

Meanwhile, Jeffrey McMorris who is representing the couple said they have one year to decide whether or not to go ahead with a full fledged lawsuit. He said his clients have felt that since Day 1 police have been trying to convict Stephen Kerr of a crime, and he adds that McDonald and Kerr believe Jaliek is alive and still hope he comes home safely.

Weekly Sessions For Jaliek

Barbara Reeley, the maternal grandmother of the missing Greenwich 12 year-old, Jaliek Rainwalker will be available every Friday afternoon from 3:00pm to 8:00pm starting February 22 nd at the Washington Square Deli in Greenwich.During her time there she will meet the public, distribute missing posters and flyers and will answer questions about her grandson, JaliekIn addition, when they become available, she will be distributing brochures about what to do if your child is missing.  These safety brochures will be provided by Chief Bell and the Greenwich-Cambridge Police Department.  The sessions will continue until further notice.

Jaliek Rainwalker of Greenwich has been missing since early November. Below is a timeline of events since the 12-year-old disappeared.

Nov. 2 – Jaliek Rainwalker reported missing by adoptive father, Stephen Kerr.

Nov. 6 – Ground and aerial search begins. Stephen Kerr refuses lie detector test. His partner, Jocelyn McDonald, takes one.

Nov. 13-14 – Police begin searching near the Battenkill Country Club in Middle Falls.

Nov. 20-21 – Search extends over VT border.

Nov. 28 – Kerr and McDonald offer $25,000 reward. Keeps decreasing by $5,000 for every month Jaliek isn’t found.

Dec. 1 – Stephen Kerr begins hanging up fliers in Albany’s West Hill and Arbor Hill neighborhoods. Claims Jaliek joined a gang there.

Dec. 13 – Jocelyn McDonald’s mother tells Capital News 9 she thinks Stephen Kerr is responsible for Jaliek’s disappearance.

Dec. 21 – FBI requests to meet with Stephen Kerr. He agrees.

Jan.1 – “Find Jaliek Task Force” created.

Jan. 10 – Kerr refuses lie detector test again.

Jan. 14 – Police name Stephen Kerr “person of interest.”

Jan. 17 – Reports surface of Kerr and McDonald moving to VT.

Feb. 7 – Hudson River search begins. Police and FBI obtain warrant to search house on Hill Street in Greenwich. Police test anonymous letter with a Westchester County postmark.

Feb. 15 – Kerr and McDonald’s lawyer files “notice of claim” against Greenwich police and village officials. Washington County D.A. Stands behind police department’s actions.
 
 

Oooooooooobama!

It looks as if the Democratic party has a new front runner, Barack Obama.  He’s won the past 10 primaries and is leading in delegates, Obama 1315 Clinton 1245.

As for the Republican race …I think it’s time for Huckabee to admit defeat.  McCain 918 Huckabee 217.
