Michael Mosley …Appeal?

leave a comment »

“If there’s ever a re-trial, I’m confident it will be done another way,” Mosley said. “I’d hate to think my life got thrown away because a sentence didn’t get brought up.”

In addition to the unknown palm print and unidentified DNA another question comes to mind.  Michael took the stand in his own defense.  Why wasn’t he able to testify to everything?  What more does he have to say?  Could this be the difference between a life behind bars and walking free?

Michael Mosley Found Guilty

with 2 comments

Michael Mosley was found guilty of first degree murder in the murders of Sam Holly and Arica Schneider.  He is facing life in prison without parole and will be sentenced on July 12, 2011.  Despite the charges, Mosley maintains his innocence and is keeping to his story that he only went to Holly’s house to give him a ride.  He hasn’t denied being present at the murder scene and has explained why his DNA and print was found in Sam’s apartment.

Reasonable doubt or was someone else involved?

There are still pieces of evidence that have yet to be explained.  Another palm print on the wall as well as unidentified DNA that was found on a doorjamb.  Not having heard all of the testimony and not knowing all of the evidence it’s hard to say if this would have been enough for reasonable doubt.  However, it could mean someone else was either with Mosley at the time or was at the scene alone before, during or after the murders took place.

Mosley’s Attorney Terry Kindlon says his client plans to appeal.

I plan on following this case more closely next time around.
